Against Terminal 542 Manager – Gary Forbes

To whom it may concern,
Since Gary Forbes has become terminal manager for the Jacksonville facility, he has made it clear that he will not cooperate with the union, its officers and/or its members. Any member who challenges his authority will end up being harassed, intimidated and/or threatened accordingly. Documentation of these most recent cases are listed below;

Harassment, Intimidation and Threats:
After seeing how long it has taken to resolve past grievances, members are choosing not to push any grievances in fear of retaliation. Management has invoked fear upon our members and has rewarded those who remain union intolerant.
Nonetheless, the examples on the following pages are black and white to the fact that Gary Forbes is managing the Jacksonville terminal at a biased, personal level and not that of a professional one. Our members today, are in greater need of union involvement then ever before.

Dear Sir and Brother:
As you know from our brief conversation during the recent Staff Conference, we are having a number of issues with the Auto Truck Jacksonville Terminal Manager, Forbes. It was my understanding from our conversation that if we could not resolve the mileage calculation problems locally, I should sent the matter on up the line to you.
Shop Steward, Daggett and I have met with Forbes on a number of occasions, in an attempt to work out these problems. This is in addition to several telephone calls and e-mail transmissions.
On or about June 27, 2006, after not receiving any response from Forbes, I again spoke with Gary concerning the company’s position regarding discrepancies in mileage calculations which is causing considerable losses in pay for the Drivers.
During this telephone conversation, Forbes told me that, “the Company had two (2) mileage guides (A&B). (One guide to charge the customer and pay IFTA road taxes and the other manipulated guide to pay the driver) Forbes also stated that he had asked Shumaker to allow known repetitious mileage codes to go into the system. This would eliminate those mileage discrepancies and no further loses on those routes.
I informed, Forbes that I would like to have a response in time for my monthly meeting with the Drivers. When I finally received Forbes’ response (attachment A) he failed to address any of the issues we had previously discussed.
At the monthly ATT membership meeting, held on Friday, June 30th, I reported the company’s position regarding mileage calculation discrepancies.
Also, (Attachment B) to this letter you will find a document from Steward Daggett that is documenting Forbes’ attempt to harass and retaliate against him for continuing to push this mileage issue.
We have gone as far as we can in getting this matter resolved locally. Therefore, in accordance with Article 22 – GRIEVANCE AND ARBITRATION PROCEDURE, Section 1 (B) of the current Collective Bargaining Agreement, I hereby refer this mileage discrepancies and harassment of our Union Steward dispute to your level for resolution.
